Terms of Service

1) Booking & Retainer

• A session/event is officially booked once the agreement is accepted and a 20% non-refundable retainer is paid in advance.

• The retainer reserves your date/time and is applied toward the total.

• The remaining balance is due on or before the session/event date (unless otherwise agreed in writing).

• Dates are not held without the retainer.

2) Cancellations & Rescheduling (retainer language)

• If the client cancels, the retainer is forfeited.

• If the client reschedules, the retainer may be transferred to one new date (subject to availability) when notice is provided as early as possible.

3) Weather (Outdoor + Equine)

• Weather decisions prioritize safety.

• If conditions are unsafe (storms/lightning/extreme weather), the session will be rescheduled at no additional charge.

• Overcast conditions may still proceed and often photograph beautifully.

4) Turnaround Time & Delivery

• Final edited gallery delivery is within 1 week of the session/event date.

• Galleries are delivered digitally via an online gallery.

• The photographer is not responsible for print quality from non-professional print sources.

5) Editing & Artistic Style

• Client has reviewed the photographer’s portfolio and agrees to the photographer’s timeless, documentary editing style.

• Edits include exposure, color correction, and overall consistency.

• RAW/unedited images are not delivered.

• Additional retouching (advanced edits/object removal) may be available for an added fee.

6) Copyright & Usage

• Sweet Moments Photos retains full copyright to all images.

• Client receives a personal-use license to download, print, and share images.

• Images may not be sold, used commercially, or heavily altered (strong filters, face/body edits) without written permission.

7) Marketing Use (Model Release)

• Client grants permission for Sweet Moments Photos to use images for portfolio, website, social media, and marketing.

• If the client prefers privacy, a marketing opt-out can be requested in writing before the session.

8) Location Rules & Permissions (Barns/Events/Venues)

• Client is responsible for obtaining any required permissions/fees for the chosen location (barn, venue, park, event facility, etc.).

• Photographer will follow venue/barn rules and safety guidelines.

9) Safety (Equine + Events)

• Horses and animals can be unpredictable. Client assumes all risk related to animals and the environment.

• Photographer is not liable for injuries, damages, or losses involving animals, guests, venue conditions, or client actions.

• Photographer may pause/stop the session if conditions become unsafe.

10) No Guarantee of Specific Shots

• Photographer will make every reasonable effort to capture important moments and requested images, but specific photos cannot be guaranteed due to lighting, weather, timing, guest cooperation, animal behavior, or venue restrictions.

11) Late Arrivals

• Late arrival reduces shooting time.

• If a client is significantly late, the session may need to be rescheduled at photographer discretion.

12) Archiving & Re-Delivery

• Galleries are archived for a limited time. Clients are responsible for downloading and saving their images after delivery.

13) Liability Limit

• Photographer’s liability is limited to the amount paid by the client.

• Photographer is not responsible for events outside their control (acts of nature, venue restrictions, sudden illness/emergency, etc.).

14) Agreement

By booking, the client confirms they have read, understood, and agree to these Terms of Service.
